I understand that an online medical visit or telemedicine (telehealth) can be a great option for minor medical issues and not ideal for severe or life-threatening illnesses. I understand that treatment offered on DoctorHelpMySkin.com is on the basis of clinical judgment, in the absence of a complete physical examination. I agree to follow up with a doctor for in-person evaluation or seek emergency care if my symptoms worsen or do not improve in a timely manner.
I acknowledge that I have no cognitive impairment and I'm capable of making a sound medical decision.
I understand that I'm engaging in telemedicine (telehealth) consultation and I accept the risk of misdiagnoses.
I hereby consent to and authorize DoctorHelpMySkin.com Medical Providers (which may be a or combination of Medical doctors, Physician Assistants, Nurse Practitioners, and Medical Assistants) to administer and perform medical evaluation and treatment deemed necessary and release DoctorHelpMySkin.com of any legal responsibility. I understand that the Medical Providers that provide advice through DoctorHelpMySkin.com may not be U.S. Board Certified Dermatologists.
I understand that electronic communication technology will be used during online consultation, and such a consultation will not be the same as a direct patient/health care provider visit due to the fact that I will not be in the same room as my health care provider.
I understand there are potential risks to this technology, including interruptions, unauthorized access, and technical difficulties.
I understand that my healthcare information may be shared with DoctorHelpMySkin.com medical team (MDs, PAs, NPs and Medical Assistants) and my pharmacy for the purpose of prescribing appropriate medication. The above-mentioned people will all maintain the confidentiality of the information obtained.
Telemedicine or Telehealth carries the risk of misdiagnosis or delayed diagnosis, which could lead to patients not receiving the proper treatment or even receiving the wrong treatment. I understand these potential risks and willing to proceed with a consultation with DoctorHelpMySkin.com.
Due to the potential risk of misdiagnosis or delayed diagnosis, I understand and agree to seek immediate medical care if my symptoms do not improve within a timely manner (typically within 48 hours).
I understand that the treatment, therapy or recommendations provided by DoctorHelpMySkin.com's medical team is an initial and first-line approach and I agree to follow up with a doctor within the next few weeks for a re-evaluation. I further understand that it is my responsibility to follow all recommendations made by the Medical Providers that provide me advice on the DoctorHelpMySkin.com website.
I understand that the health care provider or I may discontinue the telemedicine (telehealth) consult/visit if it is felt that the electronic communication technology are not adequate for the situation.
I understand that I have the right to withdraw my consent to the use of telemedicine or telehealth at any time in the course of care. As long as the consent is in force, DoctorHelpMySkin.com medical team may provide health care services to me via telemedicine/telehealth without the need to sign another consent form.
I have had the alternatives to a telemedicine or telehealth consultation explained to me, and I'm choosing to participate in a telemedicine or telehealth consultation. I understand that some parts of the exam involving physical tests may be limited due to the fact that I will not be in the same room as my health care provider.
I acknowledge that your healthcare information may be shared with DoctorHelpMySkin.com's staff, its affiliates, and subsidiaries and relevant pharmacy for the purpose of providing appropriate treatment and prescription.
I understand that DoctorHelpMySkin.com. utilizes both synchronized and asynchronized (store and forward) and I have visited www.doctorhelpmyskin.com to familiarize myself with these types of telemedicine practices, and DoctorHelpMySkin.com's scope of practice.

I understand that my payment to DoctorHelpMySkin.com, consultation fee, does not cover the prescribed medication and I still have to pay the pharmacy for my medications.
I understand that DoctorHelpMySkin.com does not complete prior authorization or any documents required by insurance to cover the medicine.

ACCORDINGLY, DOCTORHELPMYSKIN.COM MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY, TIMELINESS OR COMPLETENESS OF SUCH DATA OR THAT SUCH DATA WILL MEET YOUR REQUIREMENTS OR THAT OF YOUR PARTICIPATING MEDICAL PROVIDER.
YOU AGREE AND UNDERSTAND THAT YOUR USE, ACCESS, DOWNLOAD, OR OTHERWISE OBTAINING INFORMATION OR DATA FROM THE MEDICAL DEVICES IS AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL LOOK SOLELY TO ANY REPRESENTATION, WARRANTIES, AND COVENANTS MADE BY THE MANUFACTURER OF SUCH MEDICAL DEVICE TO YOU IN THE EVENT SUCH MEDICAL DEVICE MALFUNCTIONS OR OTHERWISE CAUSES ANY DAMAGE TO YOU, YOUR DATA, OR ANY OF YOUR DEVICES. ANY TERMS, CONDITIONS, WARRANTIES, OR REPRESENTATIONS ASSOCIATED WITH SUCH MEDICAL DEVICE ARE SOLELY BETWEEN YOU AND SUCH MEDICAL DEVICE MANUFACTURER.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE DOCTORHELPMYSKIN.COM PARTIES OR THROUGH OR FROM THE SERVICES, CONTENT, DOCUMENTATION, OR MATERIALS WILL CREATE ANY WARRANTY OF ANY KIND. DOCTORHELPMYSKIN.COM DISCLAIMS ANY AND ALL LABILITY FOR THE ACTS, OMISSIONS, AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE SERVICES, CONTENT, DOCUMENTATION, OR MATERIALS.
YOUR SOLE REMEDY AGAINST DOCTORHELPMYSKIN.COM FOR DISSATISFACTION WITH THE SERVICES, CONTENT, DOCUMENTATION, OR MATERIALS IS TO STOP USING THE SERVICES, CONTENT, DOCUMENTATION, AND MATERIALS. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN YOU AND DOCTORHELPMYSKIN.COM.
DOCTORHELPMYSKIN.COM reserves the right to restrict or terminate your access to the Services or any feature or part thereof at any time and for any reason. DOCTORHELPMYSKIN.COM further reserves the right to do any of the following, at any time and without notice: (a) to modify, suspend or terminate operation of or access to the Services, or any portion of the Services, for any reason; (b) to modify or change the Services, or any portion of the Services, and, except as otherwise provided in these Terms or the Privacy Policy, modify or change any applicable policies or terms; and (c) to interrupt the operation of the Services, or any portion of the Services, as necessary to perform routine or non-routine maintenance, error correction, or make other changes.
IN CERTAIN JURISDICTIONS, THE LAW MAY NOT PERMIT OR MAY LIMIT THE DISCLAIMER OF WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU AND MAY BE LIMITED IN ITS APPLICATION. EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL THE DOCTORHELPMYSKIN.COM PARTIES BE LIABLE TO YOU OR TO ANY OF YOUR AGENTS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES INCLUDING, WITHOUT LIMITATION, ANY DAMAGES RESULTING FROM LOSS OF USE, DATA, GOODWILL, REPUTATION, FAILURE TO PROVIDE NOTICE OR ALERT, OR OPPORTUNITIES, WHETHER OR NOT THE DOCTORHELPMYSKIN.COM PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, ON ANY THEORY OF LIABILITY (WHETHER SUCH LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE OR ANY OTHER CAUSE OF ACTION, INCLUDING THE FAILURE OF ESSENTIAL PURPOSES), RESULTING FROM: (1) THE USE OR INABILITY TO USE THE SERVICES, CONTENT, DOCUMENTATION, OR MATERIALS; (2) ANY OTHER SITE YOU ACCESS THROUGH A LINK ON THE SERVICES, CONTENT, DOCUMENTATION, OR MATERIALS; (3) ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY USE OF THE SERVICES.
If, notwithstanding the other provisions of these Terms, DOCTORHELPMYSKIN.COM is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Application or these Terms, DOCTORHELPMYSKIN.COM’S LIABILITY WILL IN NO EVENT EXCEED $10,000. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN DOCTORHELPMYSKIN.COM AND YOU.
The communications between you and DOCTORHELPMYSKIN.COM use electronic means. You (a) consent to receive communications from DOCTORHELPMYSKIN.COM in an electronic form; and (b) agree that all terms and conditions, agreements, notices, disclosures, and other communications that DOCTORHELPMYSKIN.COM provides to you electronically satisfy any legal requirement that such communications would satisfy if it were to be in writing. The foregoing does not affect any statutory rights you may have.
These Terms, and your rights and obligations hereunder, may not be assigned, subcontracted, delegated, or otherwise transferred by you without DOCTORHELPMYSKIN.COM’s prior written consent, which may be withheld at DOCTORHELPMYSKIN.COM’s sole discretion, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void. DOCTORHELPMYSKIN.COM may assign, subcontract, delegate, or otherwise transfer or sublicense any rights (including license rights) granted to DOCTORHELPMYSKIN.COM hereto.
DOCTORHELPMYSKIN.COM will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor, materials, or changes in regulations.
YOU AND DOCTORHELPMYSKIN.COM AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMSMUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
The parties hereto are independent contractors and nothing in these Terms is to imply an agency, joint venture, partnership, or fiduciary relationship between such parties.
DOCTORHELPMYSKIN.COM may provide notice to you by e-mail to the most recent e-mail address on file with DOCTORHELPMYSKIN.COM. Where DOCTORHELPMYSKIN.COM requires that you provide an e-mail address, you are responsible for providing DOCTORHELPMYSKIN.COM with your most current e-mail address. In the event that the last e-mail address you provided to DOCTORHELPMYSKIN.COM is not valid, or for any reason is not capable of delivering to you any notices required or permitted by these Terms, DOCTORHELPMYSKIN.COM’s dispatch of the e-mail containing such notice will nonetheless constitute effective notice. You may give notice to DOCTORHELPMYSKIN.COM at the mailing address set forth in Section 1. Such notice will be deemed given when received by DOCTORHELPMYSKIN.COM by letter delivered by a nationally recognized overnight delivery service or first class postage prepaid mail with receipt confirmation.
A printed version of these Terms will be admissible in judicial or administrative proceedings based on or relating to use of the Services or these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Any waiver or failure to enforce any provision of these Terms on one occasion will not be deemed a waiver of any other provision or of such provision on any other occasion.
If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will remain enforceable, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
Termination or expiration of these Terms for any reasons will not release either party hereto from any liabilities or obligations set forth in these Terms which remain to be performed or by their nature would be intended to be applicable following any such termination or expiration.
You may not use, export, import, or transfer the Services, Content, Documentation, or Materials except as authorized by U.S. law, the laws of the jurisdiction in which you obtained the Services, Content, Documentation, or Materials, and any other applicable laws. In particular, but without limitation, the Services, Content, Documentation, and Materials may not be exported or re-exported (a) into any United States embargoed countries; or (b) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce’s Denied Person’s List or Entity List. By using the Application, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also will not use the Application for any purpose prohibited by U.S. law, including the development, design, manufacture or production of missiles, nuclear, chemical or biological weapons. You acknowledge and agree that products, services or technology provided by DOCTORHELPMYSKIN.COM may be subject to the export control laws and regulations of the United States. To the extent applicable, you will comply with these laws and regulations and will not, without prior U.S. government authorization, export, re-export, or transfer DOCTORHELPMYSKIN.COM products, services or technology, either directly or indirectly, to any country in violation of such laws and regulations.
These Terms and the Privacy Policy is the final, complete and exclusive agreement of the parties hereto with respect to the subject matter hereof and supersedes and merges all prior discussions between the parties with respect to such subject matter.
Capitalized terms defined in the singular include the plural and vice versa. The word “any” means “any and all.” The Section headings appearing in these Terms are inserted for convenience only and in no way define, limit, construe, or describe the scope or extent of such Section or in any way affect such Section. The words “herein,” “hereof,” “hereunder,” and other words of similar import refer to these Terms as a whole and not to any particular Section or other subdivision.
